A bill to increase fines was submitted to the Rada.

At the next plenary session, the Verkhovna Rada plans to consider a bill on imprisonment for up to 5 years for refusing a medical examination and fines of up to UAH 204 thousand for failure to appear at the TCC, writes "Judicial and Legal Newspaper".

Fines for citizens who do not appear on summons to the TCC and otherwise violate the laws on defense, military duty and military service, mobilization training and mobilization will be increased.

The relevant bill 10379 on amendments to the Criminal Code and the Code of Administrative Offenses from the Cabinet of Ministers, prepared by the Ministry of Defense, is going to be considered by the Verkhovna Rada on April 10-11. The fact that the draft law 10379 is included in the preliminary agenda is reported by people's deputies.

This draft law will be considered in conjunction with the Government's draft law on strengthening mobilization 10449.

This draft law also stipulates that refusal to undergo a medical examination will be equated in Article 336 of the Criminal Code to evasion of mobilization, which is punishable by imprisonment from 3 to 5 years.

Thus, the draft law 10379 developed by the Ministry of Defense amends Article 210-1 of the Code of Administrative Offenses – now it will be called "Violation of legislation on defense, military duty and military service, mobilization training and mobilization".

In peacetime, violation of the legislation on defense, military duty and military service, mobilization training and mobilization will entail the imposition of a fine on citizens and officials from UAH 34,000 to 85,000.

And during martial law – from UAH 153,000 to UAH 204,000.

It should be recalled that now Article 210-1 of the Code of Administrative Offenses provides for liability for violation of the legislation on defense, mobilization training and mobilization. For example, failure to appear on a summons for an initial summons to the military registration and enlistment office. For committing an offense for the first time, the fine for citizens ranges from 1700 UAH to 3400 UAH.

The list of cases when a protocol on an administrative offense is not drawn up will be supplemented by the fact that the protocol is not drawn up in the case of administrative offenses committed during a special period under Articles 210, 210-1 of the Code of Administrative Offenses, the consideration of which is within the competence of the TCC (except for offenses committed by persons liable for military service or reservists who are in the reserve of the Security Service of Ukraine or the Foreign Intelligence Service of Ukraine), if the person does not appear without valid reasons or without giving reasons for not arriving at the call The TCC, being duly notified of the date, time and place of the summons, and if the CCC has confirming information about the receipt of the summons by the person.

The terms during which a fine can be imposed are changing. Thus, the Code of Ukraine on Administrative Offenses stipulates that an administrative penalty for committing offenses under Articles 210, 210-1 of this Code during a special period may be imposed within three years from the date of its commission or detection.

Therefore, if a citizen ignores subpoenas in 2024, he can be fined even in 2027.

It is also established that persons who violated the legislation on defense, military duty and military service, the rules of military registration, on mobilization training and mobilization, during the special period, may be detained for up to three hours to draw up a protocol, and if necessary, to identify and/or clarify the circumstances of the offense - up to three days.
